December 1, 2013 – Arrest

On December 1, 2013 at approximately 10:33pm a Town of Poughkeepsie Police Officer initiated a traffic stop in the area of Dutchess Turnpike (Rt.44) and Overlook Rd. The vehicle was stopped for having insufficient headlights and was occupied by one male operator and one male passenger.

As the town officer was conducting an interview with the operator, another officer arrived on the scene and walked up to the passenger side of the vehicle. At that point the passenger exited the vehicle, threw several items into the woods and attempted to flee.

The passenger was apprehended and a subsequent search by a Town of Poughkeepsie Police K-9 Unit was successful in locating a loaded .25 Caliber handgun, holster and ammunition in the wooded area that were thrown by the defendant.

The defendant was charged with Penal Law felonies and a misdemeanor while the operator of the vehicle was charged with a Vehicle & Traffic law violation.

Criminal Possession of a Weapon 2nd degree – Penal Law sect. 265-03 (3) Class C Felony
Criminal Possession of a Firearm – Penal Law sect. 265-01 (B) Class E Felony
Resisting Arrest  – Penal Law sect. 205.30 Class A Misdemeanor

ARRAIGNMENT INFORMATION

The defendant was arraigned before Judge Banner in the Town of Poughkeepsie Justice Court and remanded to the Dutchess County Jail in lieu of $10,000 cash/$20,000 bond to reappear on December 2, 2013 at 3pm.
